Right of Withdrawal

If you are a consumer within the meaning of Section 13 of the German Civil Code (BGB), you have the right to withdraw from this Agreement within fourteen days without giving any reason.

The withdrawal period shall be:

for services, Memberships, Vouchers and other non-physical Offerings: fourteen days from the day of the conclusion of the Agreement;
for goods, in particular Merchandise Products, simulators and other Technical Equipment: fourteen days from the day on which you or a third party designated by you, who is not the carrier, have/has acquired physical possession of the goods;
for digital content not supplied on a tangible medium, in particular Software downloads: fourteen days from the day of the conclusion of the Agreement, unless the right of withdrawal expires prematurely in accordance with the information set out below.

To exercise your right of withdrawal, you must inform us of your decision to withdraw from this Agreement. You may address your declaration to the contractual partner defined in these GTC or to:

The right of withdrawal must be exercised by means of a clear declaration, for example by a letter sent by post or by e-mail. You may use the attached model withdrawal form for this purpose; however, this is not mandatory.

If the Agreement was concluded via an online user interface and we provide an electronic withdrawal function for this purpose, you may also exercise your right of withdrawal via such withdrawal function.

To meet the withdrawal deadline, it is sufficient for you to send the notification of your exercise of the right of withdrawal before the withdrawal period expires.

Consequences of Withdrawal

If you withdraw from this Agreement, we shall reimburse all payments received from you, including delivery costs, without undue delay and in any event not later than fourteen days from the day on which we receive notification of your withdrawal from this Agreement. This does not include any additional costs resulting from your choice of a type of delivery other than the least expensive standard delivery offered by us.

For such reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you. In no event will you be charged any fees for such reimbursement.

For Agreements concerning the delivery of goods, we may refuse reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.

You must send back or hand over the goods without undue delay and in any event not later than fourteen days from the day on which you notify us of your withdrawal from this Agreement, to us or to the return address communicated by us. The deadline is met if you send back the goods before the period of fourteen days has expired.

You shall bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if such diminished value results from handling the goods other than what is necessary to establish their nature, characteristics and functioning.

Special Information on Services, Rides, Events and Memberships

If you have requested that we begin the performance of a service during the withdrawal period, you must pay us a reasonable amount. This amount corresponds to the proportion of the services already provided up to the time at which you inform us of your exercise of the right of withdrawal compared to the full scope of the services provided for in the Agreement.

The right of withdrawal also expires in the case of a service contract if we have fully performed the service and only began performance after you had expressly consented to us beginning performance before the expiry of the withdrawal period and, at the same time, confirmed your knowledge that you would lose your right of withdrawal upon full performance of the Agreement by us.

Special Information on Digital Content and Software

For contracts concerning digital content not supplied on a tangible medium, your right of withdrawal expires prematurely if we have begun performance of the contract after you have expressly consented to us beginning performance before the expiry of the withdrawal period, and you have confirmed your knowledge that, by giving your consent, you lose your right of withdrawal upon the start of performance, and we have provided you with confirmation of the contract in accordance with the statutory requirements.

Exclusions

The right of withdrawal does not apply or may be excluded for contracts for the delivery of goods that are not prefabricated and for whose production an individual choice or decision by you is decisive, or that are clearly tailored to your personal needs.

Further statutory exclusions or grounds for expiry remain unaffected.
